Electronic Signatures for HR Documents
Most HR documents can be signed electronically in the US, including offer letters, employment agreements, handbook acknowledgments, policy attestations, NDAs and commission plans, under the ESIGN Act and state UETA laws. Some forms have extra requirements: Form I-9 must use an electronic system that meets Department of Homeland Security standards, and electronic W-4 and W-9 systems must meet IRS requirements.

Special rules for Form I-9
Employers may complete, sign and store Form I-9 electronically if the system meets DHS requirements, including:
- Controls to ensure integrity, accuracy and reliability.
- Detection and prevention of unauthorized creation, alteration or deletion.
- Electronic signature attached at completion, with the signer’s identity recorded.
- Audit trails and the ability to produce legible copies for inspection.
E-Verify employers in good standing may also use a DHS-authorized remote document examination procedure. See our guide to Form I-9 online.
Special rules for tax forms
The IRS allows electronic W-4 and W-9 submissions when the requester’s system meets requirements, such as ensuring the information received is what was sent, verifying the signer’s identity, including the perjury statement and providing a hard copy to the IRS on request.
Best practices for HR e-signatures
- Get consent to conduct HR transactions electronically, and offer a paper alternative where appropriate.
- Authenticate employees, for example through SSO or verified email.
- Record document versions, especially for handbooks and policies.
- Store signed documents securely, separating I-9s from personnel files.
- Follow retention rules for each document type.
- Give employees copies of what they signed.
Automating HR document signing
A connected HR flow can:
- Generate the offer letter from ATS data.
- Collect the candidate’s signature.
- Create the employee in the HRIS.
- Send onboarding documents: W-4, state forms, handbook acknowledgment, policies.
- Track completion and send reminders.
- Store everything in the employee record.

Frequently Asked Questions
Can HR documents be signed electronically?
Yes. Most HR documents, such as offer letters, employment agreements, handbook acknowledgments and policies, can be signed electronically under the ESIGN Act and state UETA laws. Some forms, including Form I-9 and electronic tax forms, have additional system requirements.
Can Form I-9 be signed electronically?
Yes, if the employer uses an electronic I-9 system that meets Department of Homeland Security requirements for integrity, audit trails, electronic signatures and retrieval. Simply typing a name into a PDF may not meet these standards.
Can employees sign a W-4 electronically?
Yes. Employers can accept electronic W-4s through systems that meet IRS requirements, including verifying the employee’s identity, capturing an electronic signature with the perjury statement and providing copies to the IRS on request.
Do employees have to agree to electronic signatures?
Under UETA, electronic transactions apply when parties agree to transact electronically, which can be shown by conduct. Best practice is to obtain clear consent from employees and offer a paper option where appropriate, particularly for documents required by law.
How should signed HR documents be stored?
Store signed HR documents securely with restricted access, linked to the employee record. Keep I-9s separate from general personnel files, follow retention rules for each document type and make sure records can be retrieved quickly for audits.
Are electronic signatures valid for severance agreements?
Generally yes, but other legal requirements still apply. For example, releases of age discrimination claims under federal law have specific review and revocation periods. Have counsel review severance agreements and signing procedures.
