About this Privacy Policy

In order to ensure transparency and give you more control over your personal information, which is details of personally identifiable information which is provided consciously and voluntarily by you, through our NOCA Services (as defined below) or your registration and use of our Website (as defined below), by email, or other ways in which you communicate and interact with us (all together “Personal Information”), this privacy policy (“Privacy Policy”) governs how we, NOCA AI Ltd. (“NOCA”, “us”, “we” or “our”) use, collect, process and store Personal Information from or about you (“you” or “your”) in connection with your use of NOCA website https://noca.ai/ (the “Website“) and any product or service offered by NOCA on the Website, all as may change from time to time (collectively with the Website, the “NOCA Services”).

The Privacy Policy explains the types of information we may collect from you, that we may receive about you or that you may provide in the course of your business transactions with us. We are transparent about our practices regarding the information we may collect, use, maintain and process, and describe our practices in the Privacy Policy.

Please read the Privacy Policy carefully, to understand our practices regarding your Personal Information and how we will treat it. We may amend or update the Privacy Policy from time to time. Therefore, we encourage you to review the Privacy Policy for updates from time to time. If we make significant changes to how we use your Personal Information that differ from what was stated at the time of collection, these changes will take effect 30 days after being implemented.

By accessing and using NOCA Services, you accept this Privacy Policy, without limitation or qualification. If you do not agree with this Privacy Policy, you must immediately cease using NOCA Services.

What types of information do we collect?

We collect and process the following types of information:

Contact and business data. Contact and business data provided through the NOCA Services, such as first and last name, identification number, email address, physical address, job position, phone number, CVs uploaded to the Website, billing information, country of origin, number of users with access to NOCA Services, usernames and passwords related to the NOCA Services, and any other information that you decide to provide us.

Communication and interaction data. Communication data refers to the data resulting from your interaction with us, such as emails, chat messages, feedbacks, files downloaded, user research activities and product interest information.

Device and browser data. When you visit the Website or use the NOCA Services, data from your computer or mobile device may be collected, such as device type, location, information about the browser type and version, the operating system and version, the internet service provider or mobile carrier, the IP Address (or proxy server) as well as geographic areas derived from your IP address, time and date of access, duration of access, referring URL (if any), and identifiers that help us to recognize your device and validate that you are a licensed user. 

Data automatically collected. We may automatically collect certain information through your use of the NOCA Services, such as cookie, pixels, tracking technologies and similar identifiers, your Internet protocol (IP) address, and other device identifiers that are automatically assigned to your device, browser type and language, geo-location information, hardware type, operating system, internet service provider and other information about actions taken through the use of NOCA Services and Website.

Third-Party Service. If you access our Site or Service through a third-party service (for example, logging into the Site using Google or Salesforce credentials), or connect an application to Noca, that third party you connected with may pass certain information about your use of its service to Noca. This information could include but is not limited to the User ID associated with your account; an access token necessary to access that service; any information that you have permitted the third party to share with us; and any information you have made public in connection with that third-party service, such as a user profile. The information we receive will depend on the policies and your account settings with the third-party service. We do not use such information to develop, improve or train generalized AI and/or machine learning models without your prior written consent.

Usage Data Noca will compile (i) statistical and other information related to the performance, operation and use of the Noca Services, and (ii) data related to identifiable Users’ usage of features and functionality within the Noca Services (together, “Usage Data”). For purposes of clarity, Usage Data includes information provided by the Users in connection with the creation or administration of their account, including names, usernames and email addresses associated with the account, but excludes all data processed in the Services. Noca will own and retain all right, title, and interest in and to the Usage Data and may use Usage Data during and after the Term for the purposes of implementing, operating, maintaining, auditing compliance, and improving the Services and fulfilling our obligations under the applicable agreement. Noca also maintains system log files which may include internet protocol addresses, browser, internet service provider, pages visited within Noca Sites, referring/exit pages, search terms, operating system, date/time stamp, and clickstream data.

Why do we process Personal Information?

We may process Personal Information for one or more of the following purposes:

Provide you with the NOCA Services. NOCA will use Personal Information to provide the NOCA Services, including to:

  • Allow you to register and log-in to the NOCA Services.
  • Allow you to make use of the NOCA Services.
  • Use Personal Information in order to authenticate you. and
  • Personalize your experience with the NOCA Services.

Provide you with technical support. This includes resolving technical issues you encounter, responding to your requests for assistance, using Personal Information to process and answer your request for a demo, and responding to any request you may send us through the Website, email or any other way. 

Improve and enhance the NOCA Services. To improve our operations, services, systems, products, platforms and processes in order to enhance your experience, we need to understand your preferences, analyze aggregated, anonymized or statistical usage data as well as conduct surveys and researches with regards to the NOCA Services. We use this anonymous or de-identified information and/or disclose it to third parties without restrictions (for example, in order to improve the NOCA Services and enhance your experience with them).

To process job application. We will use your information to process your job application and assess you as a candidate. If we employ you, we will collect information about you and your work from time to time throughout the period of your employment. This information will be used for purposes directly relevant to your employment. After your employment has ended, we will keep this information for the applicable statute of limitation period, and thereafter destroy and/or securely delete it.

Enable security and compliance. To maintain the security and compliance of the NOCA Services with the objective to protect against, investigate and deter fraudulent, unauthorized, or illegal activity and to avoid and detect attacks or misuse of the NOCA Services, and to ensure appropriate security of our office premises and comply with any legal and regulatory obligations.

Sales, marketing and related activities. Such as to communicate news about upcoming products, services and direct advertising, and to inform you about new services or changes and modifications of the NOCA Services.

Other legitimate business purposes. Such as to conduct customer surveys, collect and assess feedback, determine the effectiveness of our marketing campaigns, and to evaluate and improve our customer relationships.

Cookies and analytics tools

We may use certain cookies and similar technologies to automatically collect information through the Website and the NOCA Services (“Cookies”). Cookies are essentially small data files placed on your device that allow us to record certain pieces of information whenever you visit or interact with the Website and the NOCA Services. If you would like to opt out of the Cookies we employ on the Website and/or the NOCA Services, you may do so by blocking, deleting, or disabling them as your browser or device permits.

The Website uses a tool called “Google Analytics” to collect information about the use of the Website. Google Analytics collects information such as how often users visit this Website, what pages they visit when they do so, and what other websites they used prior to coming to this Website. We use the information we get from Google Analytics to maintain and improve the Website and Services. We do not combine the information collected through the use of Google Analytics with the information we collect. Google’s ability to use and share information collected by Google Analytics about your visits to this Website is restricted by the Google Analytics Terms of Service, and the Google Privacy Policy. We reserve the right to remove or add new analytic tools at our discretion.

On which legal basis do we process Personal Information?

We process Personal Information only where one of the following applies:

  • We need to process Personal Information to perform our contractual responsibilities or requested Services.
  • We have a legitimate interest to process Personal Information.
  • You have given consent to process Personal Information.
  • We need to process Personal Information to comply with a legal or regulatory obligation. 

How long may we store your Personal Information?

We may retain your Personal Information for any lawfully permitted period of time consistent with the original purpose of collection, or as long as necessary to comply with our legal obligations, such as to maintain accurate accounting, backup or archival demands, financial and other operational records, or to resolve disputes.

We will determine the appropriate retention period for Personal Information on the basis of the amount, nature, and sensitivity of Personal Information being processed, the potential risk of harm from unauthorized use or disclosure of Personal Information, whether we can achieve the purposes of the processing through other means, and on the basis of applicable legal requirements (such as applicable statutes of limitation). After expiry of the applicable retention periods, Personal Information will be deleted, and 30 days after Noca’s Account Retention Policy ends, we will delete the Personal Information.

How do we protect Personal Information?

To protect Personal Information, we use adequate physical, technical and organizational security measures. However, please be aware that we cannot assure you that Personal Information will remain secure from unauthorized access to our servers. The protection of Personal Information also relies on the security of the computer, device, the network you use to communicate with us, as well as how you safeguard your user IDs and passwords. Therefore, it’s essential that you also implement suitable measures to protect Personal Information.

Who will have access to your Personal Information?

We will not disclose or share Personal Information with third parties, except to provide NOCA Services you have requested, or under the following circumstances:

We may share some Personal Information with our affiliates, business partners and/or third-party service providers, some of which may may be located outside of your jurisdiction, including with analytic companies, websites and web content creation platforms, email, marketing, CRM and other similar tool provides, identity providers, the chat-bot option on the Website (including with any third party operating such chat-bot) and cloud hosting service providers. If we make such transfer out of your jurisdiction, we will use commercially reasonable efforts to implement an appropriate level of protection to Personal Information, by implementing at least one of the following safeguards:

  • making sure the destination country has been deemed to provide an adequate level of protection for personal information; and/or
  • by executing implement data onward transfer instruments, such as data processing and protection agreements.

If needed, we will share Personal Information demanded by courts, regulators, banks, or appropriate authorities as necessary to adhere to applicable laws and regulations, as well as requests from law enforcement and other governmental agencies. This collaboration is vital for our internal compliance processes and for safeguarding NOCA, the NOCA Services, our customers, employees, property, and the wider public.

If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, dissolution, sale of all or a portion of our assets, (collectively a “Transaction”), Personal Information and other information may be shared in the diligence process with representatives or counterparties and others assisting with the Transaction, including with our attorneys and accountants, and transferred to a purchaser, successor or affiliate as part of that Transaction, along with other assets.

Where you have otherwise provided your consent to us for sharing or transferring your Personal Information.

What are your rights regarding Personal Information?

You may be afforded with the following rights, which may be subject to exceptions or limitations:

Request access, update, correction or deletion of Personal Information that we hold, if we hold, and request to further details how we process such Personal Information, all under certain conditions.

Withdraw your consent for future processing of Personal Information, where consent is the basis of processing.

  • File a complaint with us and/or with a relevant data protection authority.
  • Erasure of past data about you under certain conditions.
  • Object to unlawful data processing under certain conditions.

Additional rights may be applicable to you, based on your local laws and regulations.

You may exercise the rights mentioned above by contacting us at privacy@noca.ai. We will make every reasonable effort to honor your request promptly in accordance with applicable law, or inform you if we require further information in order to fulfil your request. We reserve the right to charge a fee were permitted by law, for instance if your request is manifestly unfounded or excessive. In the event that your request would adversely affect the rights and freedoms of others (for example, would impact the duty of confidentiality we owe to others) or if we are legally entitled to deal with your request in a different way than initial requested, we will address your request to the maximum extent possible, all in accordance with applicable law.

Integrating with third-party applications

NOCA allows you to connect and integrate third-party applications with NOCA Services, or with other third-party applications. When you do so, information such as your name, email address, phone number and device details might be shared between NOCA and those third-party applications. This helps streamline your experience and allows for seamless data transfer.

Please note that we do not use this shared information for marketing purposes. We will not send you offers, tailor ads, or conduct market research with it. Such shared information is strictly used to facilitate the connections and NOCA Services you have previously authorized.

Remember, the privacy practices of these third-party applications may differ from ours. We encourage you to review their privacy policies to understand how they handle your data.

Newsletter and other marketing materials

You may choose to receive NOCA’s periodically newsletter and other marketing materials.

Third-party websites

The NOCA Services may contain links to third-party websites. We are not responsible for the privacy practices of these websites, and encourage you to review the privacy policies of these websites before providing any information.

Protecting the privacy of minors

 NOCA Services are not intended for minors under the age of 18 years, and we do not knowingly collect or store personal information relating to minors under the age of 18 years. If you believe that a child under the age of 18 years has provided us with personal information without the consent of his or her parent or guardian, please contact us at privacy@noca.ai.   

Do Not Track

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that the Website does not currently respond to DNT signals or similar mechanisms transmitted by web browsers, and that we do not alter our practices when a DNT signal is received.
